Article 1 – Scope
These Terms of Service (the "Terms") govern, without restriction or reservation, all sales concluded remotely through the website rosenhart.fr (the "Site") between:
Rosenhart Joaillerie, sole proprietorship (micro-entreprise) registered with the RCS Nevers under number 977 674 530, registered office: 10 impasse Résidence Fanchy, 58000 Nevers, France. Email: contact@rosenhart.fr (hereinafter the "Seller"),
and any natural or legal person making a purchase on the Site (hereinafter the "Customer").
Placing an order constitutes full and unreserved acceptance of the Terms in force on the date of the order. The Seller may modify these Terms at any time; the version applicable is the one accepted by the Customer at order confirmation.

Hosting: domain name hosted by Hostinger International Ltd., 61 Lordou Vironos St., 6023 Larnaca, Cyprus. E-commerce platform provided by Shopify International Ltd., 2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland.

Article 2 – Intellectual Property
All creations (jewelry, drawings, photographs, texts, logos, graphic charters, etc.) presented on the Site are protected under the French Intellectual Property Code. Any unauthorized reproduction, representation, adaptation, or exploitation, in whole or in part, is prohibited and may give rise to legal action (Articles L 335-2 and L 335-3 IP Code).
Article 3 – Prices, Currencies, and Payment Terms
3.1 Displayed Currencies
The Site automatically displays the currency corresponding to the delivery market:
- Euro (€): France, Belgium, Germany, Italy, Spain, Netherlands, Austria, Portugal, Monaco.
- Swiss franc (CHF): Switzerland.
- Pound sterling (£): United Kingdom.
- US dollar ($): United States and any other destination not covered by the markets above.
- UAE dirham (AED): United Arab Emirates.
- Singapore dollar (SGD): Singapore.
- Hong Kong dollar (HKD): Hong Kong.
- Japanese yen (JPY): Japan.
3.2 VAT
In accordance with Article 293 B of the French General Tax Code, VAT is not applicable (basic exemption regime). Prices are therefore quoted inclusive of all French taxes.
3.3 Additional Fees
Processing and shipping fees are specified before order validation. They vary depending on the country of delivery and the carrier selected. For any destination outside the European Union (Switzerland, United Kingdom, United States, United Arab Emirates, Singapore, Hong Kong, Japan, Rest of World), import duties and taxes remain at the Customer's expense.
3.4 Conversion and Billing
Payment is debited either directly in the local currency if the payment method allows it, or in euros, after conversion by the bank or payment provider, at no additional cost charged by the Seller.
3.5 Accepted Payment Methods
- Bank card (Visa, Mastercard, American Express) via Shopify Payments, with strong 3-D-Secure authentication compliant with PSD2 directive;
- PayPal (account or card);
- Payment in 3 or 4 interest-free installments via Klarna Bank AB (subject to Klarna's approval).
3.6 Due Date
The price is payable in full at the time of the order, including for personalized or pre-ordered pieces. In the case of installment payment, the full price is deemed acquired on the date of the order; the staggering of debits is governed by the contract between the Customer and Klarna.
3.7 Security
Banking data is encrypted and processed exclusively by the aforementioned providers. The Seller never has access to it.
3.8 Retention of Title
Items remain the property of the Seller until full and effective payment of the price, notwithstanding the transfer of risks to the Customer upon delivery of the parcel to the carrier.
3.9 Payment Failure
Any refusal of debit authorization results in immediate cancellation of the order.
Article 4 – Order, Personalization, and Manufacture
4.1 Order Process
- The Customer selects products and personalization options (size, engraving, metal, enamel, etc.).
- A summary detailing the items, total price, and shipping fees is presented before payment.
- Final validation by clicking the "Pay" button constitutes electronic signature (Art. 1366 French Civil Code) and acceptance of the Terms.
- The Customer immediately receives an email acknowledging receipt of the order, constituting contract confirmation under Article L 221-13 of the French Consumer Code.
4.2 Manufacture Lead Time
Production of the pieces begins after order confirmation. Depending on the model chosen, its complexity, and the workshop's workload, manufacture takes between two (2) and four (4) weeks. The exact lead time is indicated on each product page and confirmed to the Customer before order validation. During periods of high demand, an additional lead time may be communicated to the Customer.
4.3 Availability and Order Refusal
The Seller may refuse or cancel any order presenting an abnormal nature or that is impossible to execute (material shortage, technical impossibility). In such cases, a full refund is processed within 14 days.
4.4 Modification Request
Any modification after validation (size, engraving, address) is accepted within the limits of what is feasible and may result in additional cost or extended lead time.
4.5 Tracking
The Customer is informed by email of dispatch and receives a tracking number from the selected carrier.
Article 5 – Delivery, Transfer of Risk, and Parcel Verification
5.1 Principle
The shipping times indicated below are in addition to the manufacture lead time mentioned in Article 4.2. Once the piece is manufactured, it is handed over to an international express carrier selected by the Seller (notably FedEx, DHL Express, or any equivalent provider).
5.2 Served Zones and Indicative Lead Times
The Seller delivers to the following markets. The lead times indicated are shipping times only, excluding manufacture lead time and any customs formalities:
- France: 1 to 2 business days.
- Europe (Germany, Belgium, Italy, Spain, Netherlands, Austria, Portugal, Monaco): 3 to 5 business days.
- Switzerland: 3 to 5 business days (after customs clearance).
- United Kingdom: 3 to 5 business days (after customs clearance).
- United States: 5 to 10 business days.
- United Arab Emirates, Singapore, Hong Kong, Japan: 5 to 10 business days.
- Rest of World: 7 to 14 business days.
These lead times are indicative; the Seller cannot be held liable for delays attributable to the carrier or to customs formalities.
5.3 Shipping Service
Shipment by an international express carrier with tracked service and signature on delivery. The Seller reserves the right to choose the carrier most appropriate for each shipment (notably FedEx, DHL Express, or any equivalent provider).
5.4 Shipping Fees
Indicated before order validation and calculated based on destination, weight, and value. For destinations outside the European Union, import taxes and duties are at the Customer's expense.
5.5 Transfer of Risk
The risks of loss or damage are transferred to the Customer upon delivery of the parcel to the carrier. The parcel is insured by the Seller until delivery.
5.6 Reservations on Delivery
Any apparent anomaly must be noted on the carrier's delivery note, then confirmed by email to contact@rosenhart.fr with photos, within 48 hours of receipt.
5.7 Unclaimed Parcel / Incorrect Address
Parcels not delivered due to incorrect address or non-collection are reshipped after the Customer pays new shipping fees.
Article 6 – Right of Withdrawal, Free Returns, and Exchanges
6.1 Statutory Period
The Customer has a statutory right of withdrawal of 14 days from receipt (Art. L 221-18 et seq. French Consumer Code).
6.2 Worldwide Commercial Extension
Rosenhart Joaillerie extends this period to 30 calendar days ("Rosenhart Return Guarantee"). This extension applies to all orders regardless of the country of delivery.
6.3 Exceptions
The right of withdrawal does not apply to personalized or made-to-measure items (Art. L 221-28 3° French Consumer Code).
6.4 Return Conditions
The piece must be new, unworn, in its original box, and must not have been resized.
6.5 Procedure and Return Costs
Before any return, the Customer requests a prepaid return label by email. The return is free and insured by the Seller, worldwide. The Customer keeps the proof of dispatch.
6.6 Refund
The Seller refunds the Customer via the original payment method within a maximum of 14 days after recovery of the product or receipt of proof of dispatch.
6.7 Exchange
An exchange (size or model) is possible, limited to one piece per order, subject to availability.
6.8 Import Duties and Taxes
For orders shipped outside the European Union, import duties and taxes paid cannot be refunded in case of return. These customs formalities are outside the Seller's control.

Article 7 – Statutory Warranties
7.1 Information Notice (Art. D 211-2 French Consumer Code)
The consumer has a period of two years from delivery of the goods to take action.
The consumer may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L 217-12.
The consumer is exempted from proving the existence of the lack of conformity for two years following delivery.
The statutory warranty of conformity applies independently of any commercial warranty granted.
The consumer may decide to invoke the warranty against latent defects (Art. 1641 French Civil Code); they may then choose between rescission of the sale or a price reduction (Art. 1644 French Civil Code).
7.2 Warranty of Conformity
The Seller is liable for defects of conformity existing at delivery and appearing within two years (Art. L 217-3 to L 217-20). The Customer may require the goods to be brought into conformity at no charge, by repair or replacement.
7.3 Warranty Against Latent Defects
The Customer may take action under Articles 1641 et seq. of the French Civil Code within two years from the discovery of the defect.
7.4 Exclusions
Warranties do not cover normal wear and tear, oxidation, or damage caused by corrosive products or improper use.
Article 8 – Liability
The Seller is not liable for damages resulting from improper use, lack of maintenance, or contact with corrosive substances, nor for allergic reactions related to the wearer's individual sensitivity.
The Seller is not liable in cases of force majeure (strike, fire, pandemic, network interruption, etc.).
Links to third-party sites are provided for informational purposes; the Seller is not responsible for their content or availability.
Article 9 – Amicable Settlement and Mediation
9.1 Prior Claim
Any claim must be addressed by email to contact@rosenhart.fr. Response within 48 business hours.
9.2 Mediation
Failing agreement, the Customer may seize free of charge the Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C): 49 rue de Ponthieu, 75008 Paris, https://www.cm2c.net/, contact@cm2c.net.
9.3 ODR Platform
The Customer may file a complaint on the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
9.4 Applicable Law and Jurisdiction
These Terms are governed by French law. In the absence of an amicable settlement, disputes fall within the jurisdiction of the competent French courts of the defendant's domicile or, at the consumer's choice, of the place of delivery.
Article 10 – Personal Data
The processing of the Customer's personal data is governed by the Privacy Policy accessible from the Site, which details the purposes, legal bases, retention periods, recipients, transfers outside the EU, Customer rights, and procedures for complaints to the CNIL.

Article 11 – Archiving and Evidence
11.1 Archiving
Order confirmations and invoices are archived on a reliable and durable medium for 10 years (Art. L 123-22 French Commercial Code). They may be communicated to the Customer upon simple request.
11.2 Evidence
The Seller's computerized records, kept under reasonable security conditions, constitute admissible evidence of communications, orders, payments, and transactions between the parties.
